Preventing Long-Term Impact from Youthful Indiscretions—Arizona Underage Drinking Lawyer

Arizona criminal law imposes very strict rules and harsh penalties on those who are underage and consume alcohol.  Because the issue of teenage accidents related to alcohol is so prominent, Arizona law essentially imposes a zero-tolerance policy for underage drinking and driving. A minor who is convicted of underage drinking and driving in Arizona typically will also face more severe penalties than an adult driver. At the Law Offices of Dianne Sullivan, we understand that young people sometimes make mistakes that they later regret. We are committed to the proposition that a youthful indiscretion should not determine the course of your future.

Arizona underage drinking attorney Diane Sullivan developed her skills as an effective criminal defense litigator as a prosecutor in Maricopa County with a high conviction rate.  Ms. Sullivan puts the experience and expertise of a former prosecutor behind her clients to provide extensive investigation, innovative legal strategy and tenacious advocacy on behalf of her clients. An alcohol-related offense can affect a teenager from any walk of life. Ms. Sullivan has seen the tragic results when a successful and popular honors  student suffers a misdemeanor conviction for an alcohol-related offense. We work hard to make sure that this type of youthful  mistake does not foreclose future  educational opportunities or obstruct your career aspirations.

While an adult driver (over the age of 21) is not considered to be driving under the influence (DUI) unless the driver’s blood alcohol level is .08% or above, a driver who is under 21 is considered DUI with a negligible blood alcohol level of .01%. In other words, Arizona DUI law essentially applies a zero tolerance policy for drivers who are under 21.  As with DUI for adult drivers, there is no requirement that any evidence be presented that your driving ability was actually impaired as a blood-alcohol level over the legal threshold is sufficient to sustain a conviction for underage DUI in Arizona.  Anyone under the age of 21 who is convicted of underage DUI may face the following penalties:

  • A maximum license suspension of two years
  • A one day minimum stay in county jail or nine days suspended sentence if you enter an alcohol treatment or evaluation program
  • Probation
  • Community service
  • Alcohol education classes

There are a number of other alcohol related offenses that apply to drivers who are under the age of 21.  If you are driving with an open container in your vehicle, you may be cited for violation of the open container law and be required to pay a substantial fine.  Because Arizona takes a hardline stance against underage drinking, you may face a two-year driver’s license suspension merely for drinking alcohol, even if you do not get behind the wheel of a car.  Many teenagers use fake ID cards to purchase alcohol.  However, this is a misdemeanor offense and can result in a maximum four months county jail term and a fine.
